These Terms of Service ("Terms") govern your access to and use of the Meisterwerk Racing website and your purchase of any products or services from Meisterwerk Racing ("Meisterwerk", "we", "us"). By using this site or placing an order, you agree to these Terms. If you do not agree, do not use the site or order our products.
1. Competition and off-road use only
All exhaust systems, headers, X-pipes, mid-pipes, test pipes, catalytic replacement sections, tips and related components sold by Meisterwerk Racing are sold for closed-course competition and off-road use only. They are not legal for use on public roadways or on any pollution-controlled motor vehicle operated on public highways.
Our products have not been certified by the California Air Resources Board (CARB) and do not carry a CARB Executive Order (EO) number. Installing or operating these products on a vehicle driven on public roads may violate the federal Clean Air Act (42 U.S.C. § 7522), California Vehicle Code sections 27156 and 38391, California Health & Safety Code section 43644, and comparable state and local emissions, tampering, and noise laws. Removal, bypass, or rendering inoperative of any emissions control device is prohibited by law when the vehicle is operated on public roadways.
By purchasing, you represent and warrant that (a) the product will be installed on a vehicle used exclusively for sanctioned racing, closed-course, exhibition, or off-road purposes, or will be used for display, collection, or export where permitted; (b) you are solely responsible for determining and complying with all federal, state, and local laws applicable to your use; and (c) you assume all responsibility, fines, penalties, and liability arising from any use of the product that does not comply with applicable law. Meisterwerk Racing accepts no liability for any citation, failed inspection or smog test, registration issue, insurance denial, or penalty resulting from installation or use of our products.
2. Orders, pricing, and payment
Products are hand-built to order. Submitting an inquiry or configuration through this site is a request, not a binding order. An order is accepted only when we confirm it in writing and payment (or the agreed deposit) is received. We may decline or cancel any order, including for pricing or description errors, and will refund amounts paid for orders we cancel. Quoted lead times are estimates and are not guaranteed.
3. Shipping, risk of loss, and returns
Title and risk of loss pass to you upon delivery to the carrier. All sales are final; we do not accept returns. Because each system is hand-built and made to order, custom and made-to-order items are non-refundable once fabrication has begun, except where required by law. If a product arrives damaged, contact us within five (5) days of delivery with photographs and we will repair or replace the damaged part as needed. See our Return Policy page for full details.
4. Fitment and installation
Fitment information is provided in good faith based on the vehicle platforms we develop for. Modified vehicles may require additional fabrication. Installation should be performed by a qualified technician. Meisterwerk Racing is not responsible for installation costs, tuning, labor, downtime, or consequential damage arising from installation or removal.
5. Lifetime warranty
We warrant our fabrication and welds against defects in materials and workmanship for the life of the product, to the original purchaser (a lifetime warranty).
Our sole obligation is repair or replacement of the defective part at our option. This warranty excludes normal discoloration or heat-tint of stainless steel and titanium, surface finish changes, corrosion from road salt or track debris, damage from impact, contact, improper installation, modification, misuse, or racing incident. Removal, shipping, and reinstallation are not covered.
6. Disclaimers and limitation of liability
Except for the limited warranty above, products are provided "as is" and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the maximum extent permitted by law. To the maximum extent permitted by law, Meisterwerk Racing's total liability arising out of or related to any product or these Terms will not exceed the amount you paid for the product at issue, and we will not be liable for indirect, incidental, special, punitive, or consequential damages. Nothing in these Terms limits liability that cannot be limited under California law.
7. Assumption of risk
Motorsport and high-performance vehicle use are inherently dangerous. You assume all risk of injury, death, and property damage associated with the use of our products and with competition or off-road driving.
8. Intellectual property
All site content, photography, designs, CAD data, scans, and the Meisterwerk name and logo are owned by Meisterwerk Racing and may not be copied or used without written permission.
9. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there.
